Welcome to Elevate Property Technologies LLC (“Elevate,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website at www.elevatepropertytechnologies.com (the “Site”) and our related software, services, and communication tools (collectively, the “Services”).

By accessing or using our Site or Services, you agree to these Terms. If you do not agree, please do not use the Services.

You agree to use the Services only for lawful business purposes related to property management, HOA operations, or vendor coordination.

  • Copy, modify, or reverse-engineer any portion of our software or workflows.

  • Use our Services for illegal, harmful, or deceptive purposes.

  • Interfere with, disrupt, or gain unauthorized access to our systems or data.

  • Misrepresent your identity or affiliation when contacting us or submitting information.

We reserve the right to refuse service, suspend accounts, or remove access if we believe these Terms have been violated.

2. Accounts and Access

To access certain parts of the Services, you may be required to provide business contact information or create an account.
You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account.

3. Service Description

Elevate provides an AI-enabled maintenance triage and vendor dispatch system designed to streamline maintenance requests for property managers, building owners, and HOAs.

Our platform integrates with or complements existing property management systems (PMS) but does not replace rent collection, accounting, or leasing platforms.

4. Fees and Payments

Pricing for Services is provided during onboarding, in your client agreement, or on request.
Unless otherwise stated, all fees:

  • Are quoted in U.S. dollars (USD);

  • Are due according to your subscription or service plan; and

  • Are non-refundable except as required by law.

We reserve the right to update pricing with notice via email or website updates.

5. Intellectual Property

All content, branding, workflows, and proprietary logic provided by Elevate — including text, graphics, logos, and automation sequences — are owned or licensed by Elevate Property Technologies LLC and protected by U.S. copyright, trademark, and trade secret laws.

You may not reproduce, distribute, or create derivative works without written permission.

You retain ownership of any business data you input into the system (e.g., property, tenant, or maintenance records). We claim no ownership over client-provided data.

6. Data Privacy

Your use of our Services is also governed by our Privacy Policy.
By using our Site or Services, you consent to our collection and use of information as described there.

7. Third-Party Tools and Integrations

Our Services may connect with third-party systems (e.g., AppFolio, Airtable, Typeform, n8n, or vendor portals).
We are not responsible for the availability, security, or performance of these third-party tools.
Your use of third-party integrations is subject to their own terms and policies.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.”
We make no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of our platform.

We do not guarantee that:

  • The Services will be uninterrupted or error-free;

  • Maintenance automations will always resolve or dispatch correctly; or

  • Vendors or external integrations will perform as expected.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Elevate and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from the use (or inability to use) our Services.

  • Our total liability for any claim shall not exceed the total fees paid by you to Elevate in the three (3) months preceding the incident.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Elevate Property Technologies LLC, its officers, employees, and partners from any claims, losses, or damages resulting from your misuse of the Services, violation of these Terms, or infringement of others’ rights.

11. Termination

We may suspend or terminate access to our Services at any time, without notice, if:

  • You breach these Terms;

  • Your payment is overdue; or

  • Your use threatens the security or functionality of the platform.

You may terminate at any time by notifying us in writing. Outstanding obligations (including payments) will remain due.

12. Changes to These Terms

We may modify these Terms occasionally.
When we do, we’ll update the “Effective Date” above and post the new version on our Site.
Continued use of the Services after such updates constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Any disputes will be resolved exclusively in the state or federal courts located in New York County, NY.
